General Terms & Conditions
All prices are in New Zealand dollars and are subject to availability of the Products or Services and can be withdrawn or varied without notice. Prices are subject to change at any time until full payment is received, and We reserve the right to correct any pricing errors or omissions. All prices are per Product or Service and include GST unless otherwise stated.
METHOD AND FREQUENCY OF PAYMENT:
We accept cash, NZ electronic transfer, Laybuy, or Credit Card.
Full payment is required prior to the release of the purchased product(s) to You.
Products can be returned within 7 days of the purchase date for a refund at the original purchase price (less shipping if applicable), or supply you an exchange, provided that the product must be in an unused, unopened condition with no damage.
Items being returned for exchanges may incur shipping charges.
Our 7 day returns policy does not apply to Faulty or Damaged goods. Faulty or Damaged goods are covered under our Warranty Terms & Conditions.
Before returning the item please email email@example.com and provide the following details (Invoice Number, Purchase Date, Item name, and the reason for return). We will contact you to confirm and will provide shipping details.
Products supplied by Domestique Limited come with manufacturer warranties.
Should You find, within a reasonable time of Your purchase, a defect or fault with a product supplied by us please contact us immediately by emailing firstname.lastname@example.org with the following details (Invoice Number, Purchase Date, Item name, contact name and phone number, description and photos of fault/damage).
Do not return the item before contacting us as some faults may be resolved over the phone, however for more complex issues we will discuss the best solution for you which may include returning the Product to us for assessment. Should we determine that the Product requires repair or replacement, we will contact the manufacturer on your behalf and arrange for the repair or replacement of the Product. Your repaired/replaced Product will be returned to you on completion and return of the Product by the manufacturer.
Shipping and Labour costs are not covered under any warranty.
We will not be liable to You if the damage, defect, or fault arose as a result of Your misuse, neglect, or mishandling of Your Product.
All our prices for products we sell include free shipping within New Zealand. Most of our items are sent within New Zealand using overnight courier and our aim is to send the same or next day of the order. Bulky Items are usually delivered in 2-3 days.
We ship some product to Australia. We offer the choice of standard mail (5-10 days) or DHL express (1-3 Days Tracked).
ASSUMPTION OF RESPONSIBILITY:
You understand that exercise may be a risk to physical health and safety if not done properly. Further you understand that it is Domestique Limited’s recommendation, that you consult a physician or sports professional prior to using any equipment or engaging in any exercise program or activity.
Domestique Limited shall not be held responsible for damages arising from the buyer's recklessness, negligence, misuse of supplied equipment, improper execution of generally acceptable exercise techniques, or for any damage or injury that occurs pursuant to any information received from us on the Internet, or by any other means now known or later developed.
LIMITATION OF LIABILITY:
Domestique Limited shall not in any event be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits arising from the purchase, hiring or service at anytime.
All information supplied to Domestique Limited is considered private and confidential. Domestique Limited will not pass your personal information on to any other party without your permission. Your personal information will be used only for the purpose for which you gave it to us.
Rental Terms & Conditions
You are hiring this rental equipment at your own risk. Please ensure you read these Terms & Conditions.
By making first payment you are accepting the terms and conditions listed below.
You are taking responsibility of care for the Rental Equipment and commit to returning the equipment in the same condition as it was supplied to you.
PROOF OF IDENTITY:
We require the following proof of identity before we can send out any Rental Equipment:
- Copy of your photo ID, either driving licence or passport. (Note: These will be safely destroyed once the Rental Equipment has been returned at the end of the rental period.)
Equipment rental payments are due 4 weekly in advance (unless otherwise stated on invoice).
In the case of non payment you agree to pay any collection costs, legal fees, court costs or any other fee or expense involved in the collection of charges owed by you or repossession of the rental item(s).
RENTAL SERVICE AREA AND DELIVERY FEES:
Our Rental setup service area is Auckland (accessible by public road). Delivery and setup is part of our rental packages, if out side our service area we will provide assisted setup and support via phone. For rental terms less than 12 weeks and outside of the Auckland Region a Shipping fee (up to $60) may be included on your first invoice.
For Power Meter Rentals you are required to return via tracked courier at your expense unless agreed otherwise.
If you plan to change address from where the rental equipment was originally setup, please notify us to ensure we are still able to fully support you while renting our equipment. If you move out of our service area the rental agreement will be terminated and you will still be required to pay all monies due under the agreed minimum rental period (unless otherwise agreed).
To avoid damage to the Equipment and ensure its safe operation, we include setup as part of the rental if in our stated service area. If you are outside of the service area, phone support will be provided during setup. You accept that fitting of the Equipment to your bike and its subsequent use is entirely at your own risk.
CONDITION OF THE EQUIPMENT:
We check the Rental Equipment when returned for any damage or excessive wear and tear. Please carefully check the Rental Equipment upon delivery, photograph any damage or wear that already exists for your own records. Please notify Domestique Limited immediately of any existing damage if you are unsure by emailing us a photo of the Equipment.
DAMAGE TO THE EQUIPMENT:
If the any of the rental equipment becomes damaged/faulty whilst in the customers possession, the Customer must not repair or attempt to repair the Equipment and should contact Domestique Limited as soon as the problem occurs.
We reserve the right to charge the customer for repair or replacement of the equipment if it is returned damaged due to misuse, a crash, or neglect.
LOSS OR THEFT OF EQUIPMENT:
The customer is responsible for the security and safekeeping of the Rental Equipment for the duration of the hire period. In the event the Rental Equipment is lost, stolen or you fail to return the unit to us, you will be required to pay the full cost of replacement.
We recommend that you contact your insurance company and advise them that you have rented equipment from Domestique Limited.
Rental Package Hire periods are minimums. If you want to return your equipment before the agreed minimum you will still be required to pay all monies due under the agreed minimum rental period.
At the completion of the stated ‘minimum’ hire period, the contract will continue in minimum hire periods of 4 weeks. To stop the contract renewing and avoid being billed for the next 4 week hire period you must give a minimum of 7 days notice of your intention to return the equipment prior to the next billing date.
Ownership of the Rental Equipment always remains with Domestique Limited.
